These Terms and Conditions govern the contractual relationship between DailyPickd (“we,” “us,” or “our”) and our customers (“you”) for all orders placed through our online stores for delivery within the United States.

2. Scope & Applicability

These Terms and Conditions apply to all visitors, users, and customers who place orders or access our online store within the United States. By placing an order or using our website, you agree to be bound by these terms.

3. Products and Display

DailyPickd offers beauty products, fashion, clothing, accessories, jewelry, and digital products.

We make every effort to display product colors, features, and descriptions as accurately as possible. However, actual colors may vary depending on your device’s display settings. We do not warrant that product descriptions, images, or other content are entirely error-free.

4. Ordering & Contract Formation

  • Order Placement: Placing an item in your cart does not reserve the product. Your order constitutes an offer to purchase.

  • Acceptance: A contract is formed only when we confirm dispatch of your items via email with a tracking number. We reserve the right to decline or cancel any order for reasons including product availability, pricing errors, or suspected fraud.

5. Pricing, Taxes & Payment

  • Currency: All prices displayed on our US store are in US Dollars (USD).

  • Sales Tax: Applicable state and local sales taxes will be calculated and displayed during checkout based on your delivery address.

  • Payment Methods: We accept major credit cards (Visa, MasterCard, American Express, Discover), PayPal, Apple Pay, Google Pay, and other methods displayed at checkout. Payment is processed immediately upon placing the order.

6. Shipping & Delivery

  • Delivery Scope: We ship to valid addresses within the United States.

  • Fulfillment: Orders are processed within standard business days. Estimated delivery times are provided at checkout and are non-binding estimates.

  • Risk of Loss: Title and risk of loss for purchased items pass to you upon our delivery of the package to the shipping carrier.

7. Returns & Refund Policy (US Final Sale)

  • Final Sale: All purchases delivered to the United States are final. We do not accept voluntary returns, exchanges, or mind-changes.

  • Damaged or Defective Items: If you receive an item that arrived damaged, defective, or incorrect, you must report it to info@dailypickd.com within 7 days of delivery, including photos of the product and package. Verified claims will be eligible for a free replacement or a full refund.

8. Order Modifications & Cancellations

Due to automated order processing, cancellations or address modifications must be requested immediately at info@dailypickd.com. Once an order has entered the fulfillment process, it cannot be canceled or modified.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE US LAW, ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DAILYPICKD / MYLCOM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR PRODUCTS OR WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE PURCHASED PRODUCT.
